A partner under this category describes as someone who is in a de-facto or married relationship with an Australian resident, citizen or permanent resident. In order to apply for the partner visa, there are certain stringent rules and regulations that are in place put out by the Department of Home Affairs (DOHA). It is generally the applicant’s responsibility to build a strong case and provide sufficient evidence for the genuinity of the relationship. To apply and to be eligible for a partner visa, the individual is required to be married or in a de facto relationship with – an eligible Australian citizen, a permanent resident or a New Zealand citizen. So, it is very important to make correct decisions in the initial stages of the partner visa process. Moreover, it has to be noted that acquiring the partner visa is a two-stage process. A temporary Partner visa (subclass 820) is generally granted while the permanent visa subclass 801) is under process.

The Partner (Provisional) visa (subclass 309) allows you to live in Australia if you are the spouse or de-facto partner of an Australian citizen, a permanent resident, or an eligible New Zealand citizen.

The Partner (Provisional) visa (subclass 309) is the first step towards a permanent Partner visa (subclass 100). You have to be outside Australia, while you are applying for the Partner (Provisional) visa (subclass 309 and also when your visa is granted. However, you can be inside Australia or offshore, when you are granted the Partner visa (subclass 100).
